The human-rights argument that ultimately stopped Gary McKinnon’s extradition was not a claim that hacking allegations should be ignored, nor a broad ruling that illness automatically shields a person from prosecution. What Article 3 meant in the extradition dispute

Article 3 of the European Convention on Human Rights states that no one shall be subjected to torture or to inhuman or degrading treatment or punishment. In McKinnon’s case, the argument was not that American courts were illegitimate or that US prisons were inherently unlawful. Rather, his lawyers contended that his combination of Asperger’s syndrome, depressive illness and extreme vulnerability meant that the process of extradition and prosecution itself created an exceptional danger. By the time Theresa May considered the case, years of litigation had already taken place. The remaining issue before her was whether extradition would breach McKinnon’s human rights. Why illness alone was not enough

One of the most important features of the decision is that it did not establish a simple rule that mental illness prevents extradition. British ministers and courts had repeatedly stressed that many defendants suffer from physical or psychiatric conditions yet still face extradition proceedings. What made McKinnon different was the assessment of risk. The evidence presented to the Home Secretary was not merely that he would find extradition distressing. The argument was that the foreseeable consequences of extradition included a very high likelihood of self-harm and possible suicide. May’s parliamentary statement carefully separated criminal responsibility from human-rights obligations.
