Introduction
Theresa May’s 2012 decision to stop Gary McKinnon’s extradition is often remembered alongside his claims about UFOs, secret space programmes and unusual files allegedly found on NASA and US military systems. That association has led some people to assume that the ruling somehow vindicated his allegations. It did not.
The Home Secretary’s intervention was a human-rights decision based on medical evidence, particularly the risk that McKinnon could take his own life if extradited to the United States. Neither May’s statement nor the legal process that surrounded it made any finding that McKinnon’s UFO-related claims were accurate, credible or supported by evidence. The ruling protected him from extradition; it did not validate the content of what he said he had discovered. What the ruling did not prove
The most important distinction in the case is between the reason McKinnon became famous and the reason extradition was blocked.
McKinnon openly stated that he had searched government and NASA systems because he believed information about UFOs and advanced technology was being concealed. Over the years he described seeing references to “non-terrestrial officers” and claimed to have viewed an image of an unusual craft. However, when Theresa May announced her decision, she did not discuss the truth of any UFO claim. Her statement focused on McKinnon’s health, his diagnosis of Asperger’s syndrome, depression, and the assessed risk of suicide if extradition proceeded. The legal question she addressed was whether extradition would be compatible with his human rights. As a result, the decision cannot reasonably be read as government confirmation that UFO evidence existed within the systems McKinnon accessed.
Why the decision was medical and legal
The language used by May makes the basis of the ruling unusually clear.
In both her official statement and her parliamentary remarks, she explained that she had concluded extradition would create a very high risk of McKinnon ending his life. She therefore withdrew the extradition order because proceeding would be incompatible with his human rights. The decision centred on vulnerability and mental-health evidence rather than on the underlying subject matter that had motivated the hacking. Contemporary reporting and later legal analysis reached the same conclusion. Coverage of the decision consistently described it as a response to psychiatric assessments and suicide-risk evidence. Academic discussion of the case likewise treats it as an important example of how autism-spectrum conditions and mental-health concerns can affect extradition decisions. Nothing in the ruling required the Home Secretary to determine whether McKinnon had actually found secret spacecraft images, hidden NASA files or evidence of extraterrestrial contact.
The UFO claims left outside the ruling
A common misunderstanding is that because McKinnon escaped extradition, authorities must have accepted that he had discovered something significant.
The public record does not support that conclusion.
McKinnon’s most famous claims included:
- A list of alleged “non-terrestrial officers”.
- References to ships that he believed indicated a secret space fleet.
- An image he described as a cigar-shaped craft.

These claims remained personal assertions. The extradition decision did not test them, authenticate them or require any government agency to confirm or deny them. Importantly, no publicly released ruling from the case established that the alleged files existed in the form McKinnon described, nor that they contained evidence of alien technology.
How public memory blurred the distinction
The confusion arises partly because two separate narratives became fused together in public discussion.
The first narrative concerns hacking, extradition law and human rights. The second concerns UFOs, secrecy and alleged discoveries inside government networks. Because both narratives involve the same individual, later retellings sometimes treat the successful extradition challenge as if it strengthened the UFO story.
Media coverage before and after the ruling often repeated McKinnon’s UFO motivations because they were the most unusual aspect of the case. Yet the official record shows a different sequence. The government accepted neither the truth nor the falsity of the UFO allegations when deciding the extradition question.
