How sympathy can blur evidential standards

McKinnon’s case attracted sympathy from across the political spectrum. This is a common confusion in controversial cases. A person may receive legal protection, public sympathy, or procedural relief without their broader claims being accepted as true. The fact that campaigners believed McKinnon deserved humane treatment does not imply that they accepted his account of extraterrestrial evidence.

From a sceptical perspective, the key point is that legal decisions and evidential conclusions operate under different standards.

A government may decide that extradition would be unjust, dangerous, or disproportionate without making any judgement about a defendant’s theories or motivations. McKinnon himself repeatedly stated that his motivation for searching government systems was his belief that evidence of UFOs and advanced technologies was being concealed. Those motivations became part of the public story surrounding the case. However, motivation is not evidence. A person can sincerely believe they are pursuing hidden information without successfully finding it. The distinction becomes clearer when examining the legal record. Official documents discuss alleged computer intrusions, damage claims, extradition procedures, medical assessments, and human-rights concerns. For sceptics evaluating McKinnon’s UFO narrative, this separation is important. The blocked extradition demonstrates that British authorities accepted the seriousness of his medical condition. It does not demonstrate that British authorities accepted the substance of his UFO claims.

The lasting source of confusion

The confusion persists partly because the most memorable aspects of the story are often presented together: a hacker searching for UFO secrets, a decade-long extradition battle, political controversy, and a dramatic final intervention by the Home Secretary. As a narrative, these events can appear connected.

Historically, however, they were connected only through the same individual. McKinnon’s search for UFO evidence helped explain why he accessed the systems. The extradition fight concerned how he should be prosecuted and whether extradition would violate his rights. Theresa May’s intervention addressed the latter question, not the former.
