Why cybercrime creates overlapping jurisdictions
Traditional criminal law was built around territory. A burglary occurs in a particular place, and the local courts usually deal with it. Cybercrime often breaks that assumption.
In cases such as McKinnon’s, the alleged conduct occurred physically in Britain because the keyboard, internet connection, and suspect were located there. Yet the affected computers were in the United States, the alleged victims were American institutions, and much of the investigative effort was undertaken by US authorities. This overlap is common in hacking cases. A person may never leave the UK yet allegedly gain unauthorised access to systems located overseas.
